TERMS AND CONDITIONS

1. Agreement to Terms

By accessing and using the Dualité website (https://www.dualite.net/), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site.

2. Services

Dualité provides creative design and branding services. Specific project terms, deliverables, timelines, and pricing will be outlined in separate project agreements or proposals.

3. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Dualité or our content suppliers and is protected by copyright and intellectual property laws.

4. Project Work & Ownership

Pre-Payment Work: All creative work remains the property of Dualité until full payment is received.

Final Deliverables: Upon full payment, clients receive the agreed-upon usage rights as specified in the project agreement.

Portfolio Rights: Dualité reserves the right to display completed work in our portfolio and promotional materials unless otherwise agreed in writing.

5. Client Responsibilities

Clients agree to:

Provide timely feedback and approvals

Supply necessary materials, content, and information

Ensure all provided materials do not infringe on third-party rights

Make payments according to agreed schedules

6. Revisions & Changes

The number of revision rounds will be specified in individual project agreements. Additional revisions beyond the agreed scope may incur extra charges.

7. Payment Terms

Payment schedules will be outlined in project proposals

Late payments may incur interest charges

Work may be paused on accounts with overdue payments

8. Cancellation & Refunds

Cancellation terms will be specified in individual project agreements

Work completed up to the point of cancellation will be billable

Deposits are generally non-refundable

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project.

10. Limitation of Liability

Dualité shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or Site.

11. Dispute Resolution

Any disputes arising from these terms shall be governed by the laws of New South Wales, Australia. The parties agree to first attempt to resolve any dispute through mediation before commencing legal proceedings. If mediation is unsuccessful within 60 days, the dispute shall be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

12. Modifications

Dualite reserves the right to modify these terms at any time. Continued use of the Site after changes constitutes acceptance of the modified terms.
